The Auctioneer holds the right to deny admittance to any person. Any announcements made on-site on auction day will super cede any oral or written statements made prior to that time. This auction is not available to residents of any state where the real estate may not be in compliance with the real estate laws of that state. In the unlikely event that the owner does not honor any bid or fails to close title in accordance with the winning bid or contract entered into with respect to this property, the Auctioneer will not be held responsible or liable in any way. Likewise, the Auctioneer or Mopper-Stapen Auction Company will not be responsible if the property is unsatisfactory to the bidder in any way. Seller has the right to add or delete property at their discretion. A 10% auction fee will be added to the winning bid price (11% fee for an online bid). OFFERING METHOD AND REMOTE BIDDING:

On Saturday, April 19, 2008, at 2:00 PM, the properties located at 19 West 37th Street, 15 West 37th Street, 109 East 37th Street and 2237 Norwood Avenue, Savannah, Georgia will be auctioned with on-site bidding held at 109 East 37th Street. Phone or absentee bidding arrangements can be made for those interested parties who will not be able to attend. Please contact Larry Troutman, Auctioneer at 770-331-9180. Bids can also be placed online through www.liveauctioneers.com. Due diligence packets are available online.

AUCTION REGISTRATION TERMS AND CONDITIONS:

To register to bid on this property, a $120,000 non-refundable cashiers check made payable to the bidder is required. The registration fee is applied against the ten percent down payment. The balance is due in full at closing within 30 days. You may register to bid at any time during preview, or on auction day beginning at 1:00 PM. Bidding will begin promptly at 2:00 pm on the rear deck of 109 East 37th Street. Online bidding will begin on Tuesday, March 24, 2008 and will end at midnight on Wednesday, April 16, 2008. Online deposits are due no later than 1:00 PM EST, Thursday, April 17, 2008. Any properties that fail to reach the online reserve bid will be offered for sale at the live auction.

BUYER'S PREMIUM:

A ten percent (10%) Buyer's Premium will be added to the winning bid price for the property to arrive at the total contract price paid by the purchaser(s). An eleven percent (11%) Buyer's Premium will apply to any winning bids that are registered through www.liveauctioneers.com.

SHOWING INSTRUCTIONS:

All properties will be open on Sunday, April 6, 2008 and April 13, 2008 from 1:00 pm - 5:00 pm. All other showings will be by appointment. Contact Dicky Mopper at the Mopper-Stapen Auction Company, 912-663-5500 to schedule an appointment.

BROKER PARTICIPATION:

A 2% commission will be paid to any properly licensed Buyer Broker who registers a successful buyer according to the Broker Buyer guidelines. To obtain these guidelines, contact Larry Troutman, Auctioneer at 770-331-9180.
